Terms of Service

1. Acceptance of these Terms

By creating an account, accessing, or using Twunked, you agree to these Terms of Service and any policies referenced in them, including the Privacy Policy and Photo Guidelines. If you do not agree, do not use the service.

2. Eligibility and accounts

• You must be at least 18 years old to create or use a Twunked account. Minors are not permitted to register, upload content, or use the service.
• You must provide your genuine date of birth and accurate registration information. A self-reported date of birth does not by itself establish verified identity or age. Twunked may request additional age or identity verification where appropriate or legally required.
• You are responsible for keeping your login credentials secure.
• You may not impersonate another person, create deceptive accounts, or use another member's account without permission.
• You are responsible for activity that occurs through your account unless you promptly report unauthorized access.

3. Community features

Twunked may allow members to create profiles, upload photos, rate photos from 1 to 5 stars, comment, participate in contests, interact with other members, and use other community features. Features may be changed, limited, suspended, or removed at any time.

4. Your content

You keep ownership of content you submit. By posting content on Twunked, you give Twunked a non-exclusive, worldwide, royalty-free license to host, store, reproduce, resize, display, distribute, and otherwise use that content as reasonably necessary to operate, promote, secure, and improve the service.

You represent that you have the rights and permissions needed to upload the content and that your content does not violate another person's privacy, publicity, copyright, trademark, or other rights.

Permitted photos: Twunked allows only non-explicit photos of adults. Shirtless photos, swimwear, underwear, tasteful suggestive poses, and implied nudity may be allowed only when genitals, the anus, and buttocks are fully covered and no sexual activity is depicted. The words “soft-core” or “implied nudity” never make otherwise prohibited content acceptable. Twunked does not allow exposed intimate areas or sexually explicit material.

• No exposed private parts: No visible genitals, anus, or bare buttocks, including through transparent or see-through clothing, image edits, or inadequate covering.
• No sexual activity: No actual or simulated intercourse, oral sex, masturbation, sexual touching, or other depicted sexual acts.
• No sexually explicit displays: No graphic or lascivious focus on intimate areas or poses intended to depict sexual activity, even if some body parts are obscured or covered.
• Adults and consent only: Everyone depicted must have been at least 18 years old when the image was created and must also be an adult when it is uploaded. You must have permission to create and share images of each identifiable person depicted. Images taken when someone was under 18 are not eligible merely because that person is now an adult.
• All locations: These content restrictions apply to profile photos, galleries, contest entries, and photos shared through other Twunked features, including private areas.
• Moderator approval: Every photo submitted for public display must be reviewed and approved by a Twunked moderator before it appears publicly. Submission does not guarantee approval. Twunked may reject or remove a photo if it does not meet these standards.

Members must not upload content that may be illegal, that requires special legal compliance measures not supported by Twunked, or that violates the separately published Photo Guidelines. Twunked may apply stricter standards where necessary for member safety or legal compliance.

5. Ratings and contests

• Ratings represent member activity and are not a guarantee of quality, popularity, identity, or eligibility.
• Do not manipulate ratings, create fake accounts, use bots, purchase fraudulent votes, coordinate artificial voting, or interfere with contest results.
• Contest-specific rules, entry requirements, prizes, deadlines, payment terms, and eligibility requirements may apply in addition to these Terms.
• Twunked may remove entries, disregard suspicious activity, correct technical errors, or disqualify accounts when reasonably necessary to protect contest integrity.

6. Prohibited conduct

• Illegal activity, fraud, threats, harassment, stalking, or exploitation.
• Any photo of a person who was under 18 when the photo was created, any sexual or exploitative content involving minors, or attempts to solicit such content.
• Non-consensual intimate imagery, secretly recorded content, or photos shared without necessary permission.
• Exposed genitals, anus, bare buttocks, see-through exposure, actual or simulated sexual activity, masturbation, or other sexually explicit or lascivious imagery, even where the people depicted are adults.
• Falsifying your age, misrepresenting another person's age or consent, attempting to evade photo review, or repeatedly uploading content previously rejected by moderators.
• Malware, spam, automated scraping, unauthorized access, denial-of-service activity, or attempts to bypass security.
• Publishing another person's sensitive personal information without permission.
• Using Twunked to infringe intellectual-property rights or evade moderation or enforcement.

7. Payments and third parties

Some features or contests may involve payments or third-party payment providers. Payment processing may be governed by separate terms from those providers. Unless required by law or specifically stated otherwise, fees already used for a completed digital service may be non-refundable.

8. Moderation and account action

Photo review: Photos intended for public display are subject to moderator approval before publication. Review may include checking age-related concerns, consent concerns, and adherence to the content standards above. Approval does not guarantee that a photo will remain available or establish that the image complies with every applicable law.

Reports and enforcement: Members may report suspected violations using the reporting or support tools available on Twunked. Twunked may reject, restrict, remove, or refuse content, and may warn, suspend, or terminate accounts that violate these Terms, the Photo Guidelines, applicable law, or the safety and integrity of the service. Moderation cannot guarantee that every violation will be detected immediately. Twunked may preserve information when reasonably necessary for security, fraud prevention, disputes, or legal obligations.

Age and consent checks: Twunked may request evidence concerning a member's age or the age, identity, and consent of people appearing in uploaded material when warranted or legally required. Members must cooperate with lawful requests made through approved, secure verification channels and must not publicly post identification documents. An entered birthday, acceptance of these Terms, or moderator approval is not proof of government-ID verification.

Applicable law: These content restrictions are intended to exclude sexually explicit material; however, labels and site rules alone do not determine whether any legal age-verification, recordkeeping, reporting, or other duties apply. Members may not upload content that requires legal compliance measures Twunked has not expressly approved, and Twunked reserves the right to refuse such content.

9. Service availability

Twunked is provided on an “as available” basis. No guarantee is made that the service will always be uninterrupted, error-free, secure, or available on every device. Features, rankings, counts, notifications, and other information may occasionally be delayed or affected by technical issues.

10. Limitation of liability

To the fullest extent permitted by applicable law, Twunked and its operator are not liable for indirect, incidental, special, consequential, or punitive damages, loss of data, loss of profits, or losses arising from member conduct, third-party services, unauthorized access, or inability to use the service.

11. Changes to these Terms

These Terms may be updated from time to time. Material changes may be communicated through the service or by another reasonable method. Continued use after updated Terms become effective means you accept the revised Terms to the extent permitted by law.
