1. Acceptance of these Terms

These Terms of Service govern your access to and use of Twunked, including its website, profiles, social wall, posts, comments, images, direct messages, chat rooms, photo uploads, notifications, follows, profile gifts, virtual credits, Spotlight placements, post boosts, Twunk or Not photo rating, Battles, Battle photo uploads, Battle voting, streaks, win/loss statistics, Battle scoreboards and rankings, public rating and ranking pages, and related community, discovery, and promotional features.

By registering, accessing, or using the service, you confirm that you have read, understood, and agreed to these Terms.

When you do not agree to these Terms, you must not create an account or use the service.

2. Eligibility and adult-only service

Twunked is intended only for adults who are at least 18 years old.

By using the service, you represent that:

• You are at least 18 years old.
• You have the legal capacity to agree to these Terms.
• You are not prohibited from using the service under applicable law.
• You have not previously been permanently banned unless written permission to return was provided by Twunked.

Accounts believed to belong to anyone under 18 may be immediately suspended or removed.

3. Account registration and security

You must provide accurate registration information and keep your account information reasonably current.

You are responsible for:

• Maintaining the confidentiality of your password.
• Activity performed through your account.
• Using a unique and secure password.
• Notifying support promptly when you suspect unauthorized access.

You may not sell, transfer, share, rent, or give your account to another person without written permission.

Usernames may be changed, restricted, or removed when they impersonate another person, violate intellectual property rights, contain prohibited content, or create confusion about an official staff account.

4. Acceptable use and prohibited conduct

You agree to use Twunked lawfully and respectfully. You may not use the service to:

• Harass, threaten, stalk, bully, intimidate, or encourage harm against another person.
• Publish hateful or dehumanizing content targeting protected or vulnerable groups.
• Upload nudity, pornography, sexually explicit content, or sexual content involving exploitation or coercion.
• Upload or discuss any sexual content involving a person under 18.
• Groom, solicit, exploit, endanger, or attempt to arrange sexual contact with a minor.
• Impersonate another person, organization, or Twunked staff member.
• Post stolen, deceptive, manipulated, or misleading identity photographs.
• Commit fraud, scams, phishing, identity theft, or financial deception.
• Send spam, mass solicitations, unwanted advertisements, or repetitive promotional content.
• Distribute malware, harmful code, credential stealers, or links intended to compromise another person’s device or account.
• Attempt to bypass access controls, rate limits, moderation actions, blocks, or security systems.
• Scrape, harvest, index, or collect member data through unauthorized automated methods.
• Reveal another person’s private or identifying information without permission.
• Encourage illegal activity or publish content that violates applicable law.
• Abuse the reporting, blocking, notification, or moderation systems.
• Manipulate Twunk or Not votes, ratings, rankings, Battle matchups, Battle votes, win/loss statistics, streaks, Battle rankings, contests, discovery results, or other community features through bots, scripts, coordinated fake accounts, vote trading, collusion, repeated account creation, or other deceptive methods.
• Disrupt chat rooms through flooding, repeated spam, harassment, impersonation, malicious links, or attempts to evade room bans, blocks, mutes, or moderator actions.
• Upload a photo to Twunk or Not that is not yours to submit, deceptively represents another person, or otherwise violates these Terms or the Community Guidelines.
• Upload a photo to Battles that you do not have the right to submit, use a deceptive or impersonating image, coordinate votes or matchups to inflate Battle results, or otherwise interfere with fair Battle participation.

Attempts to evade a restriction by creating another account may result in the additional account being removed.

5. Your content

“User Content” includes information or material you submit through the service, including profile text, posts, photographs, Twunk or Not photos, Battle photos, comments, usernames, direct messages, chat-room messages, reports, reactions, ratings, votes, Battle votes, Battle results, and other communications or submissions.

You remain responsible for your User Content. By submitting it, you represent that:

• You created the content or have permission to submit it.
• The content does not violate another person’s copyright, trademark, privacy, publicity, or other rights.
• Everyone shown in submitted content is an adult and consented to its creation and publication when consent is required.
• The content complies with these Terms and applicable law.

Do not upload sensitive information that you do not want other members to see. Publicly visible content may be copied, shared, photographed, or saved by others despite site controls.

6. License to operate the service

You retain any ownership rights you have in your User Content.

By submitting User Content, you grant Twunked a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, resize, transmit, and distribute that content only as reasonably necessary to:

• Operate and provide the service.
• Display content according to your selected visibility settings.
• Create technical backups and resized versions.
• Protect the service and enforce these Terms.
• Investigate reports, safety concerns, or legal requests.

This license ends when the content is deleted from active systems, except where temporary backups, security records, legal obligations, or moderation evidence require limited retention.

Twunked does not acquire ownership of your photographs, posts, or other User Content merely because you upload them.

7. Moderation and enforcement

Twunked may review, restrict, hide, remove, or preserve content when reasonably believed necessary to:

• Enforce these Terms or community rules.
• Investigate a member report.
• Protect members, staff, or the public.
• Address fraud, abuse, security threats, or technical misuse.
• Comply with a valid legal obligation.

Moderation decisions may include warnings, deleting or hiding posts, chat messages, photographs, Twunk or Not submissions, or Battle submissions; removing or correcting votes, Battle results, streaks, statistics, or rankings believed to be manipulated, erroneous, or ineligible; room-specific bans or restrictions; broader feature restrictions; temporary suspension; permanent bans; or referral to appropriate authorities.

Moderation is performed at Twunked’s discretion. The service is not obligated to monitor every communication or review every piece of content before publication.

Reports must be submitted honestly. Filing reports to harass another person or manipulate moderation may result in action against the reporting account.

8. Member interactions and safety

Twunked does not guarantee the identity, intentions, accuracy, safety, or conduct of any member.

You are responsible for exercising reasonable care when communicating with another person online or meeting someone offline.

Safety precautions may include:

• Keeping your home address, financial details, and account credentials private.
• Avoiding money transfers to people you meet through the service.
• Meeting in a public location and telling a trusted person where you are going.
• Blocking and reporting suspicious, threatening, or abusive conduct.
• Contacting emergency services when immediate danger exists.

Twunked is not a background-check service and does not represent that every member has been screened or verified.

9. Copyright and intellectual property

You may not upload content that infringes another person’s copyright or other intellectual property rights.

A copyright complaint should include:

• Identification of the copyrighted work.
• Identification and location of the material believed to be infringing.
• Your name and reliable contact information.
• A statement explaining why you believe the use is unauthorized.
• A statement that the information supplied is accurate and submitted in good faith.
• Your physical or electronic signature.

Additional copyright or designated-agent information may be provided on a separate copyright notice page.

Accounts associated with repeated infringement may be restricted or terminated when appropriate.

10. Privacy

Your use of the service is also subject to the Twunked Privacy Policy.

The Privacy Policy explains the types of information collected, why it is used, how it may be shared, and the choices available to members.

11. Virtual credits, Spotlight, post boosts, and gifts

Twunked may provide virtual credits that can be purchased, claimed for free when available, granted as a promotion, or otherwise added to an account.

Credits are a limited, revocable license to use eligible features within Twunked. Credits are not money, stored value, cryptocurrency, a bank deposit, property with cash value, or a promise of future payment. Except where expressly permitted by Twunked, credits may not be sold, transferred, exchanged, redeemed for cash, or moved between accounts.

Credit costs, available credit packages, free-credit offers, feature durations, and eligibility requirements may be displayed at the time a feature is selected and may change prospectively.

Spotlight

Members may be able to spend credits to place an eligible profile in Spotlight for a stated period. Spotlight increases the opportunity for a profile to be displayed in a promotional or discovery area, but it does not guarantee views, follows, messages, gifts, interactions, popularity, or any other result.

A Spotlight placement may end when its stated duration expires or earlier when the profile or account becomes unavailable, restricted, suspended, removed, or otherwise ineligible under these Terms.

Post boosts

Members may be able to spend credits to boost an eligible post for a stated period. A boost may increase the opportunity for the post to appear in a boosted or featured location, but placement, impressions, engagement, likes, comments, follows, messages, or any other result are not guaranteed.

A post boost may stop before its scheduled expiration when the post is deleted, removed, made unavailable, becomes ineligible, or the related account is restricted, suspended, or terminated.

Profile gifts

Members may be able to spend credits to send virtual gifts to another member's profile. A virtual gift is a digital social feature only. Sending a gift does not transfer credits, money, cash value, ownership rights, or a payment to the recipient.

A recipient may be allowed to remove or hide a received gift from their profile. Removing or hiding a gift does not restore credits to the sender. Gift availability may also depend on the recipient's privacy settings, follow relationship requirements, blocking status, or other eligibility rules.

Credit purchases and refunds

When paid credit purchases are offered, the price and quantity of credits will be shown before purchase. You are responsible for reviewing the purchase details before authorizing payment.

To the fullest extent permitted by applicable law, all credit purchases are final and non-refundable. Credits are not refundable or exchangeable because they are unused, partially used, spent on a gift, spent on Spotlight, spent on a post boost, removed from display by another member, affected by content moderation, or remaining when an account is suspended, restricted, closed, or terminated.

Spending credits on a feature is final once the feature is activated or the transaction is completed. Credits spent on a gift are not refunded if the recipient removes the gift, blocks the sender, changes privacy settings, or otherwise makes the gift unavailable.

Free, promotional, bonus, or claimed credits have no cash value and are not eligible for cash refunds, payouts, or exchanges.

Nothing in this section limits any refund, reversal, charge correction, or other consumer right that cannot lawfully be waived, including rights that may apply to an unauthorized or erroneous charge. Twunked may also issue a refund or credit adjustment at its discretion when it determines that a billing or technical error occurred.

Attempting an improper chargeback, payment reversal, fraud, or abuse of the credit system may result in removal of related credits, reversal of promotional benefits, feature restrictions, suspension, or termination, without limiting any rights available under applicable law.

12. Chat rooms, Twunk or Not, and Battles

Chat rooms

Twunked may provide public or member-access chat rooms, including rooms that permit text only and rooms that may permit photographs or other supported media. Room availability, posting permissions, upload permissions, retention, and moderation controls may vary by room.

Chat-room messages and uploads are User Content and must comply with these Terms and the Community Guidelines. Members may be blocked, muted, removed from a room, or temporarily or permanently banned when reasonably necessary to address abuse, rule violations, safety concerns, spam, or disruption.

Messages or media may be removed by the member when a self-delete feature is available or by moderators or administrators. Deleted or removed material may not remain visible to members, but limited copies may be retained when reasonably necessary for security, abuse prevention, moderation evidence, backups, or legal obligations.

Twunk or Not photo rating

Twunk or Not is a community photo-rating feature. Members may upload photographs specifically for that feature and other members may be able to vote using available rating choices such as Twunk, Hot, Not, or Pass. Available labels, scoring methods, ranking formulas, tie-breakers, and display formats may change as the feature develops.

Ratings and rankings reflect member activity and community opinions; they are not factual judgments, professional evaluations, promises of popularity, or endorsements by Twunked. A member's photo position, score, ranking, vote total, or visibility may change as new votes are submitted, votes are removed, moderation occurs, or the ranking method changes.

Twunk or Not photos may appear on rating screens, Top Rated displays, public rating pages, ranking pages, profiles, or other discovery areas of the service according to the feature's current design and applicable privacy or visibility rules. Uploading a photo to Twunk or Not means you are choosing to submit that photo for rating and display within those supported areas.

Twunked may remove a Twunk or Not photo, rating, vote, ranking entry, or related activity when reasonably believed to violate these Terms, result from manipulation, create a safety risk, or interfere with the integrity of the feature. No particular ranking, number of votes, rating, visibility, or duration of placement is guaranteed.

Battles

Battles is a community photo-comparison feature. Members may upload photographs specifically for Battles, and eligible photographs may be presented in head-to-head matchups. A member may select a preferred photo in a matchup, and the service may use those selections to calculate wins, losses, win percentage, current streaks, best streaks, rankings, or other Battle statistics.

Battle matchups are generated according to the feature's current eligibility and pairing rules. These rules may exclude a member's own photo, blocked accounts, inactive or removed photos, previously completed matchups, or other pairings that the service determines should not be shown. The exact opponent, order, frequency, and number of matchups are not guaranteed.

A winning photo may remain in a Battle while a new challenger is selected, depending on the feature's current design. Statistics such as current streak and best streak measure different things and may change as additional Battles occur. Rankings may use win percentage, total wins, streaks, participation thresholds, tie-breakers, or other criteria that may change as the feature develops.

Battle photos and Battle statistics may appear on Battle screens, scoreboards, ranking pages, member profiles, public promotional areas, or other supported discovery surfaces. Uploading a Battle photo means you are choosing to submit that photo for comparison and display within those supported areas, subject to applicable privacy, blocking, moderation, and eligibility rules.

Battle results reflect member selections and automated ranking logic. They are not factual judgments, professional evaluations, endorsements, or guarantees of popularity. Twunked may remove a Battle photo, disregard or remove a vote, correct or rebuild statistics, reset or adjust a streak, remove a ranking entry, or otherwise modify Battle data when reasonably necessary to address abuse, duplicate or invalid activity, technical errors, moderation, account status, or the integrity of the feature.

No particular Battle opponent, number of Battles, win rate, streak, rank, placement, visibility, or duration on a scoreboard is guaranteed. Battle photos that have not yet participated may appear below photos with completed Battles, and eligibility rules may affect whether a photo appears in rankings at all.

13. Account restriction and termination

You may stop using the service at any time.

Closing an account, or having an account suspended, restricted, or terminated, may result in loss of access to unused credits and active paid features. Except where required by applicable law, unused or remaining credits are not refundable or redeemable for cash.

Twunked may suspend, restrict, or terminate an account when reasonably believed that:

• The account violated these Terms.
• The account creates a safety or security risk.
• The account is involved in fraud, abuse, spam, or illegal conduct.
• The account belongs to someone under 18.
• The action is required to protect the service, members, staff, or third parties.
• Continued access would expose the service to legal or operational risk.

Access may be removed without advance notice when urgent safety, fraud, security, or legal concerns exist.

Sections that by their nature should survive termination—including ownership, disclaimers, liability limits, indemnity, and dispute terms—remain effective after account termination.

14. Service availability and changes

Twunked may add, modify, restrict, pause, or discontinue features at any time.

This may include changing which features use credits, credit prices for future transactions, Spotlight or boost durations, gift options, chat-room availability or permissions, Twunk or Not vote labels, scoring and ranking formulas, Battle pairing rules, Battle eligibility, win/loss calculations, streak logic, ranking formulas, scoreboard display rules, free-credit offers, promotional placements, or the way such features are displayed. Changes will apply prospectively unless otherwise stated or required by law.

The service may occasionally be unavailable because of maintenance, security work, technical failures, hosting issues, network interruptions, or events outside reasonable control.

No guarantee is made that every feature, message, chat-room post, photograph, Twunk or Not vote, rating, Battle vote, Battle matchup, streak, statistic, ranking position, notification, or account record will remain available indefinitely.

Members are responsible for keeping copies of content they consider important.

15. Disclaimers

To the fullest extent permitted by applicable law, the service is provided on an “as is” and “as available” basis.

Twunked does not guarantee that:

• The service will always be available, secure, or error-free.
• Member information or User Content will be complete, truthful, current, or accurate.
• Content will never be copied, lost, damaged, or accessed without authorization.
• Use of the service will lead to any particular relationship, interaction, or result.
• Spotlight, post boosts, gifts, or other credit-based features will produce any minimum number of views, follows, messages, likes, comments, engagements, or other results.
• Twunk or Not ratings, vote totals, rankings, or public displays will remain unchanged or produce any particular result, visibility, popularity, or interaction.
• Battle opponents, matchups, wins, losses, win percentages, current streaks, best streaks, rankings, scoreboard positions, or Battle displays will remain unchanged or produce any particular result, visibility, popularity, or interaction.
• Chat rooms, direct messages, photographs, or other communications will always be delivered, retained, available, private from other members, or free from unwanted conduct.
• Every violation will be detected or prevented.

Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

16. Limitation of liability

To the fullest extent permitted by applicable law, Twunked and its owners, operators, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from:

• Your use of or inability to use the service.
• User Content or conduct by another member, including conduct in chat rooms or direct messages.
• Ratings, votes, Battle selections, Battle statistics, rankings, streaks, reactions, or other member opinions or community-generated results.
• Unauthorized account or data access.
• Loss of content, messages, photographs, profits, opportunities, or reputation.
• Offline meetings or transactions between members.
• Third-party services, websites, advertisements, or links.
• Loss of access to virtual credits or credit-based features resulting from expiration, moderation, account action, service changes, technical issues, or another member's permitted use of privacy or gift removal controls, except to the extent liability cannot lawfully be limited.

Where liability cannot be excluded, it will be limited to the greatest extent allowed by applicable law.

Some jurisdictions do not allow certain exclusions or limitations, so portions of this section may not apply to you.

17. Indemnity

To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Twunked and its owners, operators, employees, contractors, and representatives from claims, losses, liabilities, damages, and reasonable expenses arising from:

• Your User Content.
• Your use or misuse of the service.
• Your violation of these Terms.
• Your violation of another person’s rights.
• Conduct performed through your account.

18. Disputes and applicable law

Before filing a formal claim, you agree to contact Twunked and make a reasonable attempt to resolve the issue informally.

These Terms are governed by the laws applicable in the jurisdiction where Twunked is operated, without regard to conflict-of-law principles, except where consumer law requires another result.

Any legal proceeding must be brought in a court with proper jurisdiction over the dispute unless applicable law provides otherwise.

Nothing in these Terms prevents either party from seeking urgent relief relating to account security, intellectual property, fraud, abuse, or immediate safety concerns.

19. Changes to these Terms

These Terms may be updated to reflect changes to the service, safety practices, legal obligations, or business operations.

The effective date at the top of this page will be changed when the Terms are revised.

Material changes may also be announced through the service or by another reasonable method.

Continuing to use the service after updated Terms take effect means you accept the revised Terms. When you do not agree to a revision, you must stop using the service.

These Terms are intended to describe the current Twunked service and are not a substitute for legal advice. They should be reviewed by a qualified attorney familiar with the service's operating jurisdiction, ownership structure, payment practices, privacy practices, moderation procedures, and current features.
